# Roof Terms of Service **Terms version:** `roof-terms-2026-11-07-r11` **Prepared:** 2026-11-07 **Status:** Release candidate; not yet effective. Publication requires completion of the operator's release checks. ## 1. Provider and Scope Roof is provided by **Oliver Rüsenberg**, a sole proprietor using **ORGate** as a business designation. ORGate is not a separate legal entity. Postal address: **In der Gasse 10a, 90574 Rosstal, Germany** Email for support, legal notices and complaints: **info@orgate.net** These Terms govern the Roof application and messaging service. The separate Privacy Policy explains personal-data processing; it is not a request for blanket consent. Individual agreements and mandatory consumer rights take precedence over conflicting provisions of these Terms. ## 2. Eligibility and Contract Formation You must be at least **18 years old** and legally able to enter this contract under the law applicable to you. Roof is not offered to minors. Do not create an account for a minor or misrepresent your eligibility. Before registration, you can open these Terms and the Privacy Policy, correct your entries or cancel registration. The free-service contract is formed when you accept these Terms and Roof successfully creates your account. Merely visiting a page or opening the application is not acceptance. Purchasing Premium requires a separate, expressly confirmed store transaction; registering does not create a paid subscription. The contract language of this version is English. Mandatory local-language and other consumer-information requirements remain applicable. The current [Terms](https://roof.orgate.net/legal/terms.txt) and [Privacy Policy](https://roof.orgate.net/legal/privacy.txt) are available on our Website and can be viewed in the app. In the app you may separately choose to save the exact validated text currently being viewed for offline access in Settings and, after account deletion, on the signed-out landing screen. Saving is optional and is not required to register or accept the Terms. These public legal texts contain no account-specific purchase or acceptance receipt. Roof does not send Terms, Privacy Policy or withdrawal receipts by email. Saved copies remain on the device until the app's local data is removed; device removal or app-data clearing can remove them. ## 3. Accounts and Authentication Choose an available username and an offered authentication method: device identity, Google or Apple. An email entered in Roof account settings is optional, not a password or verified recovery method. Sign-in providers may separately supply identity information as described in the Privacy Policy. Protect your device and credentials and inform us promptly of suspected unauthorized access. You are not automatically liable for every action through your account; responsibility depends on applicable law and your own conduct. Loss of an unlinked device identity may prevent access. We cannot promise recovery from a username or optional email alone. Account ownership is based on stable account and authentication identifiers, not the display name. Do not impersonate others, use another person's credentials, evade a valid suspension or interfere with another account. ## 4. Service and Its Limits Roof provides messages of up to 250 visible characters in a Global stream and membership-restricted neighborhood streams. Global posts are shared with other authorized users of that stream. Neighborhood posts are available to authorized members, who may copy or share what they see. Names and invitation codes do not establish confidentiality or geographical proximity. Roof is not end-to-end encrypted. Ordinary messages are selected from limited retained history; recipients are not guaranteed every message. Server ordinary history lasts at most six hours under the intended release configuration and may be removed sooner at capacity limits. Normal selection uses a one-hour window; eligible unread favorite-sender messages may be selected from longer retained history. This is not a permanent archive or emergency communication service. An app process keeps up to 200 messages per stream in memory. That history may remain visible after server expiry and is lost when the process ends. Broadcast, system and promotion messages have separate delivery rules. The Privacy Policy explains retention, reports and deletion. Free accounts have a 300-second sending cooldown and access to up to three non-Global neighborhoods. When a Premium entitlement is active, it provides a 30-second cooldown, optional automatic updates, access to up to ten neighborhoods, neighborhood creation and no promotion messages. Free accounts may receive non-personalized promotions. Premium does not suppress necessary service or safety notices. Features labelled as future or unavailable are not currently supplied Premium features. Neighborhood administrators manage membership within application permissions. If the last administrator leaves, a remaining member may be appointed; empty neighborhoods may be deleted. Loss of Premium can limit access to retained memberships without automatically erasing them. ## 5. Content Rules Submit content only where you have the necessary rights and a lawful basis to disclose personal information about others. Unlawful content or conduct, threats, incitement to violence, sexual harassment, abuse or insults directed at others, discriminatory harassment, stalking, fraud, impersonation and unjustified disclosure of private information are prohibited. Do not publish sexual exploitation material, malware, spam or unauthorized advertising. Do not submit payment-card details, passwords, identity-document numbers, health information or similarly sensitive information. Do not bypass authentication, membership checks, rate limits or valid restrictions, or deliberately disrupt the service. Acts that cannot lawfully be prohibited, including statutory interoperability rights, remain permitted. You remain responsible for your own contributions under applicable law. These Terms impose no blanket obligation to indemnify us for third-party claims or losses you did not cause culpably. ## 6. Reports, Moderation and Review Use in-app reporting for available message-related reports. Anyone, including a non-user, can report suspected illegal content to **info@orgate.net**. Identify it precisely, including message ID, stream or neighborhood, sender and approximate time where known; explain the alleged illegality and provide supporting information. Provide your name and email so we can acknowledge and answer, except where the applicable law does not require identification. Please state that you believe the information is accurate and complete. Do not redistribute illegal material unnecessarily; contact us about safe evidence submission if needed. The operator assesses reports manually. Automated authentication, rate limits and access restrictions are technical controls, not a substitute for that assessment. Measures can include content removal, warnings, feature restrictions and temporary or permanent suspension. We consider seriousness, context, frequency, effects, evidence and affected people's rights and interests. A report alone does not automatically cause a permanent ban. Where required, we provide acknowledgments, decisions and reasons for restrictions, identifying relevant legal or contractual grounds and review options. Notice may be limited where legally prohibited or to protect a legally protected investigation. Urgent protective action can precede notice. Applicable duties to notify authorities of suspected serious criminal offences remain unaffected. To contest a decision, email **info@orgate.net**, identify the decision and explain the error or additional evidence. We provide manual reconsideration without a fee. This does not restrict court proceedings or statutory complaint and out-of-court rights. No mandatory arbitration or waiver is created. The same email is our contact point for users and competent authorities, including under the EU Digital Services Act. English and German are accepted. We do not promise constant monitoring or uninterrupted staffing. For immediate danger, use the appropriate emergency service. ## 7. Premium, Payment and Cancellation **New Premium purchases are currently unavailable in the app.** The purchase action is disabled. The app can check or restore an existing store entitlement, but a displayed entitlement or temporary access does not mean that a new subscription can be purchased. The app may display configured Store offer information, including a price and billing period, but it does not currently let you complete that purchase. The intended monthly base price for a future offer is EUR 0.99 in euro-denominated Store storefronts and USD 0.99 in US-dollar storefronts. Other currencies are intended to use the Store's localized conversion of the USD 0.99 base, including Store rounding and localization. These are planned reference prices, not a current offer or guaranteed exchange-rate promise. If purchases are enabled in a later release, the store confirmation screen must show the then-current local price, billing period, taxes, renewal terms and contracting seller before you confirm. The store-specific offer and receipt govern that transaction; these Terms do not themselves make a purchase offer. If later enabled, Premium will be offered only through an Apple App Store or Google Play in-app purchase flow; Roof has no direct checkout or website purchase. The seller depends on the store, billing method, country and transaction. Apple's terms say the transaction may be between you and Apple and/or the content provider; the product page and purchase flow identify the relevant seller. Under the German Google Play terms, Google Commerce Limited is the provider for ordinary Google Play purchases; a separately selected alternative billing provider may instead be the seller. Check the transaction confirmation and seller-specific terms. RevenueCat assists with entitlement administration and is not, by itself, the seller. See the [German Apple Media Services Terms](https://www.apple.com/legal/internet-services/itunes/de/terms.html) and [German Google Play Terms](https://play.google.com/intl/de_de/about/play-terms/), or the localized terms presented for your account. Nothing in these Terms removes mandatory rights against the seller or against Roof where Roof is legally responsible. If you later subscribe, billing frequency and automatic renewal are those shown in the purchase flow. Ordinary cancellation is managed using the account and procedure for that transaction: [Apple subscription cancellation](https://support.apple.com/de-de/118428) or [Google Play subscription cancellation](https://support.google.com/googleplay/answer/7018481?hl=de). Cancellation normally stops renewal at the end of the current paid period; the applicable store terms explain any regional exception. Cancellation is not necessarily a statutory withdrawal. Where German mandatory rules require indefinite continuation cancellable on no more than one month's notice, those rules prevail. Store deadlines cannot shorten mandatory rights. Uninstalling Roof or deleting its account does not itself cancel a store subscription; cancel it separately. For purchase or discretionary refund assistance, see [Apple refund information](https://support.apple.com/de-de/118223) or [Google Play refund information for the EEA and UK](https://support.google.com/googleplay/answer/7659581?hl=de). Those general refund pages do not replace a statutory withdrawal declaration unless the seller's applicable terms expressly make that particular flow the withdrawal route. These links do not waive mandatory rights against Apple, Google, Roof or another legally responsible party. Roof can refund only amounts it received itself. For a store-collected payment, direct the request to the seller identified for that transaction, while preserving any claim against Roof where it is legally responsible. Contact **info@orgate.net** if you cannot identify the responsible party or to exercise rights against Roof. We do not require you to abandon those rights or exclusively pursue a store. If the operator grants temporary test access, its stated expiry ends that access; it does not automatically create a paid subscription. Any future price or offer change requires the notices, agreement, cancellation options and store procedures required by law. ## 8. Consumer Right of Withdrawal Subscription cancellation, statutory withdrawal and account deletion are different actions. **This withdrawal notice covers only a distance contract for the free Roof service with Oliver Rüsenberg, and only where the consumer has a statutory right to withdraw.** Premium purchases, if later enabled, are separate transactions. Identify the seller and applicable terms from the purchase screen, confirmation and receipt. For Apple transactions, the [German Apple Media Services Terms](https://www.apple.com/legal/internet-services/itunes/de/terms.html) describe the transaction-specific withdrawal process, including the option to select the transaction in purchase history and submit a withdrawal through Apple's flow. For standard Google Play-billed purchases in Germany, the [German Google Play Terms](https://play.google.com/intl/de_de/about/play-terms/) describe withdrawal rights and how to declare withdrawal to Google Commerce Limited, including the relevant form/contact route. If an alternative billing provider is shown, use that seller's terms and route instead. The general [Apple refund page](https://support.apple.com/de-de/118223) and [Google Play refund information](https://support.google.com/googleplay/answer/7659581?hl=de) cover refund requests and do not by themselves establish that every generic refund request is a statutory withdrawal declaration. These references do not imply that a store is always the seller or limit a statutory claim against Roof. ### Instructions on Withdrawal For the free Roof service contract, if the statutory right applies, you may withdraw within **14 days without giving any reason**. The period expires 14 days after the day that contract is concluded. Mandatory rules on commencement, including receipt of required information, remain unaffected. Withdrawal ends the relevant contract as required by law; it is not a Premium refund request against a store seller. Account deletion and data erasure are separate. The in-app combined flow explicitly records the withdrawal first and asks separately before deleting the account. If you withdraw by post or email, state separately whether you also request account deletion; deletion is not inferred from a withdrawal declaration alone. To exercise withdrawal from the free Roof contract, use **Settings > Account > Withdraw and delete account** in the app while signed in. Enter your full name and confirm the declaration in the separate submission step. The app sends it to the server and, after server receipt, displays and saves a receipt on this device with the declaration and receipt time. It then asks separately before deleting the Roof account as described in section 12; after confirmed withdrawal, the app does not offer a keep-account option. Resolve any pending message send before starting because account deletion is blocked while a send outcome is uncertain. Do not use this route to withdraw from a separate Store purchase. If the in-app function is unavailable, inform **Oliver Rüsenberg, In der Gasse 10a, 90574 Rosstal, Germany, info@orgate.net** by an unequivocal statement, for example a posted letter or email. You do not need to use the model form. Sending your communication before the deadline is sufficient. You may send your declaration after registration, provided the applicable withdrawal period is still open; you are withdrawing from the contract, not simply rejecting an individual clause in these Terms. Include your name and a way to identify the Roof contract. A postal or email route does not replace any electronic withdrawal function required by law. For a contract with Roof, we will reimburse amounts paid directly to and received by Roof under that contract without undue delay and no later than 14 days after being informed of withdrawal, using the original payment method unless expressly agreed otherwise, without a reimbursement fee, subject to mandatory law. If Apple, Google or another party was the contracting seller and collected the Premium payment, direct the withdrawal or refund request to that seller using the applicable transaction procedure. This does not remove any statutory claim against Roof where Roof is legally responsible. Where a contract provides for paid services and you expressly requested performance to begin during the withdrawal period, a proportionate amount for services supplied until withdrawal may be payable only where the statutory conditions, including the required prior information and express request, are fulfilled. Accepting these Terms or creating a free Roof account is not that separate request. Starting an ongoing subscription does not by itself extinguish withdrawal rights; any early expiry requires all applicable statutory conditions and a separate express request where required, not a blanket waiver. For Store-billed Premium, use the withdrawal procedure in the seller's terms identified for that transaction; use ordinary cancellation or refund help only for the purpose described there. ### Model Withdrawal Form This optional form is only for withdrawal from the free Roof service contract described above. Do not use it for an App Store or Google Play purchase; use the procedure provided by the seller identified in that transaction. Complete and return only if you wish to withdraw. To: Oliver Rüsenberg, In der Gasse 10a, 90574 Rosstal, Germany; info@orgate.net - I/We hereby give notice that I/We withdraw from my/our free Roof service contract: - Contract/account reference (if known): - Name of consumer(s): - Address of consumer(s): - Signature of consumer(s), only if submitted on paper: - Date: Delete whichever does not apply. This form is not compulsory. ## 9. Quality Rights and Updates Mandatory consumer rights regarding supply and conformity of digital products remain applicable, including remediation, price reduction, termination, reimbursement and damages where provided by law. They can also apply to a free service where statutory conditions involving personal-data processing are met. No "as is" disclaimer replaces them. We provide updates, including security updates, for the legally required period and information about necessary installation and consequences. Compatibility is described in the current store listing. Failure to install affects statutory claims only where legal conditions are met, including proper information and adequate instructions. Report defects and missing paid features to **info@orgate.net**. Maintenance, security incidents and technical failures can interrupt service, but do not excuse mandatory contractual obligations. ## 10. Changes Necessary security, legal-compliance and conformity updates follow applicable law. Other changes to an ongoing digital service require a valid reason, such as an operating-system or interface change, a concrete security or abuse risk, or a changed legal requirement. Such changes impose no extra cost and will be explained clearly. For changes adversely affecting access or use beyond a minor extent, we provide reasonable advance information on a durable medium about the change, timing and rights. Where section 327r BGB applies, you may terminate without charge within 30 days after receiving the information or, if later, after the change. Statutory exceptions, including continued unmodified access without extra cost, and refund and data-retrieval rights remain applicable. This does not authorize arbitrary removal of core functions, retroactive contract changes or price changes by announcement alone. Material Terms changes require valid agreement or another applicable statutory basis. Silence or continued use is not blanket acceptance. Updating the Privacy Policy is not automatic permission for new processing purposes. ## 11. Content Rights You retain your rights in contributions. You grant us non-exclusive, royalty-free permission limited to hosting, technically reproducing, transmitting and displaying content to appropriate recipients and necessary moderation and security processing. Delivery may cross borders. This is not permission to sell content or use it in unrelated advertising. Permission lasts only as necessary for those purposes, subject to lawful evidence preservation and the Privacy Policy's retention rules. Statutory exceptions apply independently. Roof software, branding and operator material remain with their owners, without restricting lawful use, statutory exceptions or open-source licences. ## 12. Ending the Contract and Deletion You may end the free contract and request account deletion through account settings or by contacting us, subject to proportionate identity verification. If the app has an unresolved message send whose outcome cannot yet be confirmed, you must review and resolve or explicitly discard that pending send before account deletion can proceed. Discarding an uncertain send does not retract it if the server already accepted it. After the server confirms account deletion, active account data is removed subject to specific legal exceptions and isolated backup expiry described in the Privacy Policy. Subscription cancellation, withdrawal and erasure requests have different effects; section 7 explains store cancellation. We may terminate the free contract on at least 30 days' notice, or for serious cause under applicable law. A warning or opportunity to remedy a breach is provided when required. Immediate proportionate restrictions remain possible for serious safety, security or legal concerns. Paid obligations and refund rights cannot be avoided by calling termination moderation. Deletion removes active account data subject to specific legal exceptions and backup rules in the Privacy Policy, not copies independently made by recipients. Applicable rights to retrieve user-provided non-personal content on termination remain intact; we do not promise indefinite storage or reconstruction of content already lawfully expired. ## 13. Liability Liability is unlimited for intent and gross negligence, culpable injury to life, body or health, and mandatory statutory liability, including the German Product Liability Act where applicable. Expressly assumed guarantees and fraudulent concealment remain governed by law. For slight negligence in breaching an essential contractual obligation, liability is limited to foreseeable damage typical of the contract. Such obligations enable proper performance and are those on whose compliance you may ordinarily rely. Subject to the preceding paragraph, liability for slightly negligent breaches of other obligations is excluded only to the extent permitted by law. These rules also apply to our legal representatives and persons used to perform our obligations. They do not restrict mandatory consumer remedies, applicable data-protection compensation rights or non-excludable liability. There is no fixed monetary cap. Responsibility for user content and third-party outages is determined by law, not automatically excluded. ## 14. Governing Law and Disputes German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. This choice does not deprive consumers of mandatory protections of their habitual residence otherwise applicable. Statutory jurisdiction remains unchanged; consumers are not bound to an exclusive German court. We are not willing to participate voluntarily in proceedings before a consumer arbitration board. Statutory participation and information duties remain unaffected. Contacting us or internal review is not required before legal action. Where applicable, we provide the information required by section 37 VSBG after an unresolved consumer dispute. If a provision is ineffective, statutory law applies in its place and governs whether the remaining contract continues. No automatic substitution by the most commercially similar clause is agreed. ## 15.
